Terms of service.

These Terms of Service ("Terms") govern your use of Kyndrify, a digital twin and AI-generated video service provided by Through The Glass Creatives Global FZCO ("Kyndrify," "we," "our," or "us"). By creating an account or using the service, you agree to these Terms.

1. Account & Eligibility

You must be at least 18 years old to create an account. You are responsible for the security of your credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

2. Acceptable Use

Your use of Kyndrify must comply with our Acceptable Use Policy. The AUP is incorporated into these Terms by reference. Violations may result in immediate account suspension and termination.

3. Subscription & Billing

Paid plans renew automatically until canceled. Credits granted by a subscription reset monthly and do not carry over. Pay-as-you-go credit packs do not expire for 12 months from purchase.

Failed-payment grace period: 14 days. After 14 days of unresolved payment failure, the subscription is canceled and the workspace downgrades to the Free tier. Current credits remain usable until depleted.

We use a third-party payment processor to handle billing; their terms of service also apply to payment transactions. The current processor is named in our Privacy Policy sub-processor disclosure and available on request. Refunds are handled under our Refund Policy, which is incorporated into these Terms by reference.

4. Your Content & Likeness

You retain ownership of all content you upload (photos, voice references) and all renders Kyndrify generates from them. You grant Kyndrify a limited license to store and process this content solely for the purpose of providing the service.

Likeness consent. For each digital twin, you must provide a recorded consent video confirming that the subject (you, or the person you have authorization to represent) consents to use of their likeness in Kyndrify renders. We retain consent recordings for the life of the twin plus seven (7) years after deletion as a legal record.

Agency / delegated consent. You can capture consent yourself and upload the consent video at twin creation, or send the subject a private link to record their own consent directly. A subject who consents through that link can withdraw it at any time from a link in their confirmation email, after which you can no longer produce new renders of them. Either way, the legal consent record remains between the subject and your agency; Kyndrify is the infrastructure provider.

5. AI-Generated Content Disclosure

All output Kyndrify generates is disclosed as AI-generated. Depending on the output type, this includes machine-readable provenance (such as C2PA Content Credentials embedded in the file metadata and an invisible cryptographic watermark) and, for free-tier video, a visible on-screen AI-generated label. You may not remove, obscure, or tamper with these disclosures. Doing so is grounds for immediate account termination and may result in civil and criminal liability under applicable AI-disclosure laws (including the EU AI Act).

6. Content Moderation & Safety

To keep Kyndrify safe and to meet our legal obligations, we use automated content-safety systems, supplemented by human review, to screen uploaded media and generated output for material that violates these Terms, our AUP, or applicable law. This includes screening for child sexual abuse material (CSAM) and other illegal content.

Where prohibited material is detected, we may quarantine or remove the content, decline to process it, suspend or terminate the responsible account without refund, and preserve related records as evidence. We report apparent CSAM to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement as required by applicable law.

7. Copyright & Likeness Complaints

If you believe content created or hosted on Kyndrify infringes your copyright, or uses your face, voice, or likeness without your consent, report it to [email protected]. Include a link to or identifier for the content, a description of your rights or your relationship to the person depicted, and enough detail for us to assess the claim. We review every report within 72 hours, remove content where the complaint is validated, and terminate repeat infringers.

If your consent was recorded through Kyndrify's consent flow, you can also withdraw it at any time using the link in your confirmation email, which immediately prevents new renders of your likeness.

8. Intellectual Property

Kyndrify and its underlying systems are owned by Through The Glass Creatives Global FZCO and protected by intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works from Kyndrify itself.

9. Protected Health Information (PHI)

Kyndrify is not HIPAA-eligible and is not designed for the processing of Protected Health Information (PHI). You agree not to upload PHI to Kyndrify or use the service to generate content that would constitute PHI under HIPAA. We will update this section if and when BAA-signed compute becomes available; until then, do not use Kyndrify for any covered-entity or business-associate workflow under HIPAA.

10. Termination

You may delete your account at any time from the billing settings. We may suspend or terminate your account for violation of these Terms or our AUP. When you delete your account, your twins, uploaded media, voice references, biometric templates, and renders are erased promptly. Consent recordings are retained as a legal record of consent as described in our Privacy Policy, separate from the data we erase.

11. Disclaimers & Limitation of Liability

Kyndrify is provided "as is." We disclaim all implied warranties to the maximum extent permitted by law. Our total liability is limited to the amount you paid us in the 12 months preceding the claim.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-laws principles. Except where mandatory consumer-protection law in your country of residence provides otherwise, any dispute arising out of or relating to these Terms or the service will be referred to and finally resolved by arbitration administered by the Dubai International Arbitration Centre (DIAC) under its Arbitration Rules, seated in Dubai and conducted in English before a single arbitrator. Nothing in this section prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.

13. Changes to Terms

We may update these Terms from time to time. Material changes will be announced at least 30 days in advance via email. Continued use of Kyndrify after changes take effect constitutes acceptance.
