Terms of service.

These Terms of Service ("Terms") govern your use of Kyndrify, a digital twin and AI-generated video service provided by Through The Glass Creatives Global - FZCO ("Kyndrify," "we," "our," or "us"). By creating an account or using the service, you agree to these Terms.
1. Account & Eligibility
You must be at least 18 years old to create an account. You are responsible for the security of your credentials and for all activity under your account. Notify us immediately at hello@kyndrify.com if you suspect unauthorized access.
2. Acceptable Use
Your use of Kyndrify must comply with our Acceptable Use Policy. The AUP is incorporated into these Terms by reference. Violations may result in immediate account suspension and termination.
3. Subscription & Billing
Paid plans renew automatically until canceled. Credits granted by a subscription reset monthly and do not carry over. Pay-as-you-go credit packs do not expire for 3 months from purchase. The free starter credits granted at sign-up never expire.
Where a plan feature is described as unlimited, it is unlimited within reasonable use; we may rate-limit or pause use that is far outside normal creative work so one workspace cannot crowd out everyone else.
Failed-payment grace period: 14 days. After 14 days of unresolved payment failure, the subscription is canceled and the workspace downgrades to the Free tier. The downgrade does not change existing credit expiration schedules: unused subscription credits still expire one month after they were granted, and pay-as-you-go credits retain their original expiration dates.
We use a third-party payment processor to handle billing; their terms of service also apply to payment transactions. The current processor is named in our Privacy Policy sub-processor disclosure and available on request. All charges are final. Billing errors are corrected under our Refund Policy, which is incorporated into these Terms by reference.
If you are a consumer with a statutory right of withdrawal, you agree that the service starts as soon as you pay and acknowledge that the right of withdrawal ends once it does.
4. Your Content & Likeness
You retain ownership of all content you upload (photos, voice references) and all renders Kyndrify generates from them. You grant Kyndrify a limited license to store and process this content solely for the purpose of providing the service.
Likeness consent. For each digital twin, you must provide a recorded consent video confirming that the subject (you, or the person you have authorization to represent) consents to use of their likeness in Kyndrify renders. We retain consent recordings for at least the life of the twin plus seven (7) years after deletion as a legal record, unless the law requires longer.
Agency / delegated consent. You can capture consent yourself and upload the consent video at twin creation, or send the subject a private link to record their own consent directly. A subject who consents through that link can withdraw it at any time from a link in their confirmation email, after which you can no longer produce new renders of them. Either way, the legal consent record remains between the subject and your agency; Kyndrify is the infrastructure provider.
Deceased individuals. A Digital Twin or render that depicts someone who has died may only be created by a person with the legal authority to consent on their behalf, such as an executor or a holder of the applicable post-mortem publicity rights under the law that applies to that person. Every render remains a synthetic depiction and must never be presented as authentic footage of the person.
Sensitive and memorial content. Some people use synthetic media to remember a loved one. If you choose to do that, please do it with care, for yourself as much as for anyone else. A render is a synthetic depiction: it is not the person, it is not a message from them, and it is not evidence that anything it shows ever happened. Kyndrify is a creative tool. It does not provide grief support, companionship, therapy, or any therapeutic benefit, and emotionally sensitive uses of the service are undertaken at your own discretion and risk. 5. AI-Generated Content Disclosure
Kyndrify is rolling out technical disclosure controls across its output paths. Depending on the output type and the current rollout status, a file may include machine-readable provenance, an invisible marker, or a visible on-screen label. These controls are not yet guaranteed on every output.
Whether or not a technical marker is present, you are responsible for clearly disclosing AI-generated content when applicable law, platform rules, or the context in which you publish it requires disclosure. You may not remove, obscure, or tamper with a disclosure or provenance control that Kyndrify has applied. Doing so may result in account suspension or termination and may expose you to liability under applicable law.
6. Content Moderation & Safety
To keep Kyndrify safe and to meet our legal obligations, we use automated content-safety systems, supplemented by human review, to screen uploaded media and generated output for material that violates these Terms, our AUP, or applicable law. This includes screening for child sexual abuse material (CSAM) and other illegal content.
Where prohibited material is detected, we may quarantine or remove the content, decline to process it, suspend or terminate the responsible account without refund, and preserve related records as evidence. Apparent CSAM is escalated for reporting to the National Center for Missing & Exploited Children (NCMEC), and we cooperate with law enforcement as required by applicable law.
7. Copyright & Likeness Complaints
If you believe content created or hosted on Kyndrify infringes your copyright, or uses your face, voice, or likeness without your consent, report it to abuse@kyndrify.com. Include a link to or identifier for the content, a description of your rights or your relationship to the person depicted, and enough detail for us to assess the claim. We prioritize these reports, investigate them as promptly as reasonably possible, remove content where the complaint is validated, and terminate repeat infringers.
If your consent was recorded through Kyndrify's consent flow, you can also withdraw it at any time using the link in your confirmation email, which immediately prevents new renders of your likeness.
Intimate images. Creating or sharing intimate imagery of a real person without their consent is banned outright, whether the imagery is authentic or AI-generated. If this happens to you, report it through our content removal page. We review these reports on a priority basis and remove validated material within 48 hours.
8. Intellectual Property
Kyndrify and its underlying systems are owned by Through The Glass Creatives Global - FZCO and protected by intellectual property laws. You may not copy, modify, distribute, reverse-engineer, or create derivative works from Kyndrify itself.
9. Not a Medical or Professional Service
Kyndrify is a creative tool for making synthetic media. It is not a medical, psychiatric, psychological, mental-health, therapeutic, legal, or financial service, and nothing in the service or its output is professional advice. Using Kyndrify creates no doctor-patient, therapist-client, or fiduciary relationship. Do not rely on a render or any output for medical, legal, financial, or other professional decisions; consult a qualified professional.
Kyndrify is not HIPAA-eligible and is not designed for the processing of Protected Health Information (PHI). You agree not to upload PHI to Kyndrify or use the service to generate content that would constitute PHI under HIPAA. We will update this section if and when BAA-signed compute becomes available; until then, do not use Kyndrify for any covered-entity or business-associate workflow under HIPAA.
10. Termination
You may cancel your plan at any time from Billing → Cancel plan; it ends at the close of the period you have paid for, and nothing more is charged. You may delete your account at any time from Settings. We may suspend or terminate your account for violation of these Terms or our AUP. When you delete your account, your twins, uploaded media, voice references, biometric templates, and renders are erased promptly. Consent recordings are retained as a legal record of consent as described in our Privacy Policy, separate from the data we erase.
11. Disclaimers & Limitation of Liability
Kyndrify, and every render and other output it generates, is provided "as is" and "as available." We disclaim all implied warranties to the maximum extent permitted by law, including any warranty that output will be accurate, complete, or unique. Our total liability is limited to the greater of the amount you paid us in the 12 months preceding the claim or one hundred US dollars ($100).
Output is generated by automated systems. It may be inaccurate, incomplete, or offensive, and it does not represent the views of Kyndrify or of anyone it depicts. Do not rely on output as a sole source of truth. You are responsible for evaluating output, including with human review where appropriate, before you use or share it, and you must not use output about a person for any decision with a legal or similarly significant effect on that person, such as decisions about credit, employment, housing, insurance, education, or medical care.
You use Kyndrify, and you create and share renders, at your own discretion and risk. We present what the service can do; we do not control what you make with it or how you use it. To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or exemplary damages arising from the use of or inability to use the service, from your creation of, interaction with, or sharing of any render, or from content another user creates.
Indemnification. You agree to release, indemnify, and hold harmless Through The Glass Creatives Global - FZCO and its officers, employees, and agents from and against claims, damages, and expenses, including reasonable legal fees, arising out of or relating to your use of Kyndrify, the content you upload, the renders you create or share, or a breach of the consent representations you make under Section 4.
Nothing in these Terms excludes or limits any liability that applicable law does not allow us to exclude or limit, and nothing in these Terms takes away rights that the law of your country of residence gives you and does not let you give up.
12. Governing Law & Dispute Resolution
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-laws principles. Except where mandatory consumer-protection law in your country of residence provides otherwise, any dispute arising out of or relating to these Terms or the service will be referred to and finally resolved by arbitration administered by the Dubai International Arbitration Centre (DIAC) under its Arbitration Rules, seated in Dubai and conducted in English before a single arbitrator. Nothing in this section prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.
13. Changes to Terms
We may update these Terms from time to time. If applicable law requires advance or direct notice, we will provide it through an appropriate channel before the change takes effect. Continued use of Kyndrify after changes take effect constitutes acceptance, subject to any rights that applicable law does not allow these Terms to limit.
